Jakarta – Direktur Law Firm Telusula Indonesia, Muhammad Erry Satriyawan, SH, CPCLE memaparkan terkait tahapan persidangan penanganan perkara perselisihan hasil pemilihan Gubernur, Bupati dan Wali Kota di Mahkamah Konstitusi (MK) memasuki tahap akhir.

“Sidang putusan sengketa Perselisihan Hasil Pilkada (PHP) berdasarkan rilis dari situs resmi Mahkamah Konstitusi RI, jadwal pembacaan putusan akan dilaksanakan pada hari, Kamis, 18 Maret 2021, untuk perselisihan hasil pemilihan Bupati Belu, Bupati Kotabaru, Bupati Pesisir Barat, Bupati Bandung, Bupati Nias Selatan, Bupati Kabupaten Samosir, Bupati Malaka, Bupati Kabupaten Teluk Wondama, Bupati Karimun, dan Bupati Kabupaten Sumbawa,” kata Muhammad Erry Satriyawan.

Lanjut Erry sapaan akrabnya Advokat muda tersebut mengatakan, untuk perselisihan hasil pemilihan Bupati Kabupaten Sekadau, Bupati Kabupaten Konawe Selatan, Bupati Kabupaten Tasikmalaya, Bupati Tojo Una-Una, Bupati Kabupaten Yalimo, Bupati Nabire, Bupati Kabupaten Nabire, Gubernur Kalimantan Selatan, Bupati Morowali Utara, dan Bupati Kabupaten Halmahera Utara, jadwalnya pada hari, Jum’at, 19 Maret 2021.

“Untuk perselisihan hasil pemilihan Bupati Kabupaten Penukal Abab Lematang Ilir, Walikota Kota Banjarmasin, Bupati Labuhanbatu, Bupati Sumba Barat, Walikota Kota Ternate, Bupati Solok, Bupati Kabupaten Indragiri Hulu, Bupati Kabupaten Boven Digoel, Bupati Labuhanbatu, Bupati Kabupaten Rokan Hulu, jadwalnya pada, Senin 22 Maret 2021. Kemudian untuk perselisihan hasil pemilihan Bupati Kabupaten Mandailing dan perselisihan hasil pemilihan Gubernur Provinsi Jambi jadwalnya, Selasa, 22 Maret 2021,” paparnya.

Dengan dipercepatnya sidang sengketa, menurut Erry, semestinya diagendakan tanggal 19 – 24 Maret 2020, karena pastinya sangat dinantikan warga di daerah masing-masing yang saat ini masih diliputi ketidakpastian. Apakah majelis hakim akan menerima gugatan para pemohon atau sebaliknya. Atau pula menerima sebagiannya saja?, jika diterima, maka Komisi Pemilihan Umum (KPU) Provinsi/Kabupaten/Kota selaku pihak termohon, harus mempersiapkan kembali pelaksanaan Pemungutan Suara Ulang (PSU). Sebaliknya jika tidak diterima, maka KPU akan mempersiapkan rapat pleno penetapan calon terpilih.

“Sebagai contoh MK memutuskan PSU, untuk tiga daerah peserta Pilkada Serentak 2017. Ketiga daerah tersebut yakni Kabupaten Maybrat (Papua Barat), Kabupaten Gayo Lues (Aceh) dan Kabupaten Bombana (Sulawesi Tenggara). Dan pada pilkada 2018, dalam putusannya “Mengadili”, memerintahkan kepada KPU Provinsi Maluku Utara melakukan PSU karena telah terjadi ketidakakuratan dalam penyusunan Daftar Pemilih Tetap di enam Desa dan dua Kecamatan. Dan putusan lainnya, memerintahkan kepada KPU Kota Cirebon untuk melaksanakan PSU dalam pemilihan Wali Kota dan Wakil Wali Kota Cirebon 2018 di empat Kecamatan. Meski demikian, ada opsi lain dari putusan MK, jika gugatan pemohon terkait sanksi diskualifikasi diterima MK. Diketahui, dalil diskualifikasi pasangan calon sering muncul dalam gugatan. Namun, merujuk putusan-putusan MK sebelumnya menyatakan bahwa kecurangan terstruktur, sistematis, dan masif (TSM) merupakan kewenangan lembaga lain. Kemudian MK hanya akan mengadili jika lembaga yang mengadili TSM tidak melaksanakan tugasnya dan berpengaruh terhadap hasil suara pasangan calon. Ini didasarkan peraturan Bawaslu tentang penyelesaian pelanggaran administratif. Atas dasar itu, maka hanya ada dua opsi putusan MK nantinya yakni, PSU atau tidak,” ungkap Erry yang juga salah satu pengacara Mo-Novi dalam Pilkada Sumbawa.

Kendati demikian, terlepas dari kemungkinan-kemungkinan itu, akhir dari sengketa Pilkada nantinya adalah putusan MK. Dimana sesuai UU, putusan ini bersifat final atau berkekuatan hukum, tetap sejak diucapkan. Walhasil, tak ada upaya hukum lain yang dapat ditempuh. Dalam amar putusannya nanti, tentu saja majelis hakim akan mempertimbangkan segala sesuatu yang berkembang di persidangan dengan mempelajari bukti-bukti serta saksi-saksi yang diajukan oleh para pihak yang bersengketa.

Apabila merujuk Rekapitulasi Perkara Perselisihan Hasil Pemilihan Umum Kepala Daerah dan Wakil Kepala Daerah/Perkara Perselisihan Hasil Pemilihan Gubernur, Bupati, dan Walikota, dapat dilihat pada tahun 2018 dari 72 permohonan hanya 2 yang dikabulkan, tahun 2017 dari 60 permohonan hanya 3 yang dikabulkan, tahun 2016 dari 152 permohonan hanya 3 yang dikabulkan, tahun 2014 dari 13 permohonan tidak satupun yang dikabulkan, tahun 2013 dari 196 permohonan sebanyak 14 yang dikabulkan, tahun 2012 dari 104 permohonan sebanyak 11 yang dikabulkan, tahun 2011 dari 131 permohonan sebanyak 13 dikabulkan, tahun 2010 dari 224 permohonan sebanyak 26 dikabulkan, tahun 2009 dari 12 permohonan hanya 1 dikabulkan dan tahun 2008 dari 18 permohonan hanya 3 yang dikabulkan. Maka jika dikalkulasi perkara perselisihan hasil pemilihan umum Kepala Daerah dan Wakil Kepala Daerah/perkara perselisihan hasil pemilihan Gubernur, Bupati, dan Walikota di MK sejak tahun 2008 – 2018 sebanyak 982 permohonan dan sebanyak 76 permohonan yang dikabulkan baik seluruhnya maupun sebagian.

“Lantas, kemanakah arah putusan MK pada sengketa Pilkada Sumbawa 2020 ini?. Bahwa saya yang juga salah satu pengacara Paslon MO-NOVI tentunya tetap optimis selaku pihak terkait, bahwa permohonan akan ditolak. Terlepas dari optimisme tersebut, saya mengajak mari bersabar menanti putusan MK. Kiranya MK menangani perkara tersebut seadil-adilnya tanpa terpengaruh tekanan dari pihak manapun.
Saya menghimbau kepada semua, janganlah membuat statement yang memancing kegaduhan sekaligus provokatif, dan tidak membuat opini dengan dalih asumsi. Mari kita percayakan saja kepada lembaga berwenang yakni Mahkamah Konstitusi sebagai pemutus hasil perselisihan Pilkada Kabupaten Sumbawa 2020, toh MK memiliki integritas yang tinggi,” pungkas Muhammad Erry Satriyawan, SH, CPCLE.

Untuk diketahui, Kamis besok palu keadilan dinantikan masyarakat Sumbawa, yang tiga bulan terakhir bersabar menanti putusan benteng terakhir perselisihan sengketa Pilkada ini. Harapan bersama tentunya para pihak yang bersengketa menerima atau legowo, serta menghormati putusan tersebut. Menerima itu sebagai keniscayaan proses politik. Karena bagaimanapun, sidang perselisihan di MK merupakan proses terakhir sebelum pemenang Pilkada Sumbawa akhirnya ditetapkan dan dilantik.(K2)
